USER AGREEMENT

Thank you for using services provided by TeleStar LTD ("TeleStar").
THE AGREEMENT

Your agreement with TeleStar LTD consists of (1) this Customer Service Agreement ("CSA"), (2) the current per-minute rates. The two components are collectively, the "Agreement". By subscribing to, using, downloading the app or paying for the services, you agree to the prices, charges, terms and conditions in this agreement. If you do not agree to these prices, charges, terms and conditions, do not use the services.

This Agreement applies if you have subscribed or downloaded the app CheapCalls (iphone app) or IntCall (android app). TeleStar reserves the right to change the terms of this Agreement ("Terms") at any time.

This Agreement applies to state-to-state and international long-distance calls. State regulations and requirements, including tariffs filed with the State Public Service Commissions apply to your intrastate telecommunications services.

1. SERVICES
1.1. Acceptance

In its sole discretion, TeleStar may accept or reject your order for Services for any lawful reason. Before activation of any Service, TeleStar may check your credit, verify your identity, charge a deposit, prepayment or other fee to establish or maintain Services, or require that you execute any authorizations and verifications it deems necessary. For any number of reasons, the Services may not be activated immediately.

For abroad and overseas customers, TeleStar customer service representatives may ask for documentation for verification purposes. This may include, but is not limited to, a passport, driver's license, or a copy of the front and back of your credit card.

1.2. Credit Limits and Deposits

If TeleStar bills you for the Services and we determine that you may be a credit risk because of (1) fraudulent or abusive use of any TeleStar Services; (2) late payments for current or prior bills; or (3) high volume usage of the Services, we may require a deposit (or an advance payment as permitted by state law) to ensure payment for the Services. If you fail to pay for the Services when due, TeleStar may use the deposit to pay your balance without giving notice to you. Similarly, TeleStar may set a credit limit. If you exceed the limit, TeleStar reserves the right to restrict your access to the Services, and will provide notice of such restriction as soon as reasonably practicable. TeleStar also require that you pay its charges in less than the standard 21 days from the invoice date, by using the payment method provided by you.

1.3. Cancellation of Service by Customer

If you want to cancel your TeleStar service simply uninstall the app from your phone or email us.

1.4. Restrictions on Use of Service

The Services cannot be used in an unlawful, fraudulent or abusive manner.

If you do not use your credit balance within six (6) months from the date of purchase, you will lose the balance remaining on the card.

1.5. Discontinuation of Services by TeleStar

TeleStar may immediately discontinue or otherwise limit your use of the Services without notice if (1) TeleStar has reasonable grounds to believe that you have used the Service in an unlawful, fraudulent or abusive manner, (2) you fail to pay for the Services, (3) TeleStar determines that you are a credit risk, (4) you refuse to pay a deposit or adhere to a credit limit, required by TeleStar to reduce your credit risk, (5) you fail to provide information, or provide false information, that is essential for billing, (6) you have breached this Agreement and (7) you have acted in a manner that is threatening, obscene, harassing, or abusive to TeleStar personnel. The discontinuance of the Services by TeleStar does not relieve you of any obligation to pay TeleStar for charges due and owing for Services furnished up to the time of discontinuance.

1.6. Unauthorized Use

You are responsible for preventing the unauthorized use of the Services, and you are responsible for payment for any such unauthorized use.

2. Call Records

2.1. You can access your call records from our web site: www.intcall.info

3. Rates

3.1. Rates may vary. Rates are the rate set forth for each specific plan and/or specific destination based on TeleStar tariff price list publish on TeleStar web site www.intcall.info and the app itself. All calls are billed in 30-seconds increments and rounded up unless otherwise stated. For each answered call, billing begins only when connection with the destination occurs and ends when the caller ends the call.

The application uses internet connection to make the calls. Your phone company(3g) or a wifi access point may charge you for using the internet.

4. Rate changes and Billing

4.1. Notice of Rate Changes

TeleStar may change the per-minute rates, Surcharges and other Terms of the Agreement from time to time. TeleStar may decrease or increase per-minute rates, without providing advance notice.
TeleStar will post the rates on its website at www.intcall.info and on the app.

4.2. Billing Errors

Billing errors may occur. If you have been undercharged, we, in our sole discretion, may charge your provided credit card the amount for which you were incorrectly not charged.

5 Disputes

5.1. Disputes concerning any charges must be raised within 30 days of the payment date. Disputes may be raised by emailing us to intcallinfo@gmail.com. Any charges not disputed within 30 days of the invoice date will be considered accepted. If after an investigation TeleStar determines that the disputed amounts are in fact due, TeleStar will require payment and, if necessary, may refer the account to a collections agency for collection.

6. PRIVACY STATEMENT AND POLICIES

TeleStar LTD, ("TeleStar", "we", or "our"), and its Customers, Partners, Suppliers, and Affiliates recognize and respect the privacy expectations of our customers. The following must be read and assented to for you to use our site. By using the Site, you are stating that you have read and are agreeing to the following:

7. Privacy

7.1. Customer Privacy

TeleStar is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.

7.2. Information Collected

TeleStar can collect information from our users at several different points on our web site. We collect, retain, and use information about you for the purpose of administering our relationship with you. In order to administer our relationship with you, it is necessary for you to provide certain information upon using portions of our Site. Such information includes your name (either your name, company, or organizations name), address, phone number, e-mail address, and other information gathered through the applicable process.

7.3. Information Automatically Placed On Your Hard Drive (Cookies)

In order to provide service to you, we require that a cookie be transferred to your computer's hard disk for record keeping purposes. The Cookies capture your e-mail address and your first and last name. Cookies allow you to access our site easier by storing your password on your computer so that you do not have to enter your password each time you log onto our site. To gain access to our Site, your computer must accept Cookies.

7.4. Non-Personally-Identifiable Information Collected Automatically (IP Addresses)

We collect IP addresses. Collection of IP addresses allows us to monitor fraud on our Site.

7.5. E-mail

Note: E-mail sent to TeleStar may be used to answer questions, to follow up on questions and/or to improve the level of service provided to users. E-mail is not secure and is subject to interception by unauthorized individuals. If you wish to send personal or sensitive information, it should be sent by postal mail or phone via customer service.

7.6. Security

We maintain security measures to protect your information from loss, misuse and alteration of information under our control. Our site employs SSL 128 bit encryption when private information is passed from you to us. The level of encryption you ultimately obtain is dependent upon your browser's capabilities.

7.7. Sharing of Information

Within TeleStar, any employee access to customer information is for business purposes only and is based on a need to know basis. This information is shared with Affiliates so that we can provide services and products that meet your circumstances and needs.

7.8. Third Parties

We enter into agreements with outside companies to provide services to our users. When we enter into such agreements, we require that these companies adhere to the same strict privacy standards in regards to the security and confidentiality of your information. We also do not allow such third party companies to disseminate your information to any other party.

7.9. Unaffiliated Third Parties

As a service to our users, we partner with unaffiliated third parties to offer products and services. At no time is your confidential information provided to these third parties.

8. intcall.info, CheapCalls, INTCalls

8.1 Trademarks

The TeleStar. CheapCalls,Intcall name and logo and all related product and service names, design marks and slogans are trademarks, service marks or registered trademarks of TeleStar and may not be used in any manner without the prior written consent of TeleStar. All other product and service marks are trademarks of their respective owners

8.2 Consent to Monitoring and Disclosure

TeleStar is under no obligation to monitor the information residing on or transmitted to this server. However, anyone using this server agrees that TeleStar may monitor the server contents periodically to (1) comply with any necessary laws, regulations or other governmental requests; (2) to operate the server properly or to protect itself and its users. TeleStar reserves the right to modify, reject or eliminate any information residing on or transmitted to its server that it, in its sole discretion, believes is unacceptable or in violation of these terms and conditions

Should any user of information on this server provide TeleStar with information, including but not limited to feedback, data, answers, questions, comments, suggestions, plans, ideas or the like, such information shall be deemed to be no confidential and TeleStar assumes no obligation to protect such information from disclosure. The submission of such information to TeleStar shall in no way prevent the purchase, manufacture or use of similar products, services, plans and ideas by TeleStar for any purpose whatever and TeleStar shall be free to reproduce, use, disclose and distribute the information to others without restriction

8.3 Links

TeleStar is linked to by other Internet sites and resources. TeleStar is not responsible for the content or is in any way associated with these third parties. All inquiries regarding the linking sites should be directed to those sites. We may provide links to other web sites that we think may be of interest to our users. By providing links, we are not endorsing the materials and content disseminated at those web sites, and we are not responsible for the materials and content at any other site.

9. PROTECTION OF ID AND PASSWORD

You are required to have a password and user ID to access portions of our Site or to reinstall the app.

9.1 You are given a password and choose a user ID during registration. Information given during registration must be accurate and updated accordingly. You must be 18 years or older to use this site. In order to protect the accounts of all users, you may not select or use a user ID of another person or use a user ID in which another person has already claimed. Noncompliance with the foregoing shall constitute a breach of this Agreement. Such noncompliance may result in termination of your account. You are solely responsible for maintaining the confidentiality of your user ID and password.

9.2. TeleStar has no intention of collecting personally identifiable information (name, address, telephone number, or e-mail address) from individuals under the age of eighteen. If a child has provided us with personally identifiable information, a parent or guardian of that child should contact us at the e-mail address if they would like the information deleted from our records. We will use reasonable efforts to delete the information regarding the child from our files.

9.3. We continually strive to maintain accurate and complete information about our users, members, customers, and clients. If you believe that information is inaccurate or incomplete, you should notify intcallinfo@gmail.com with concerns and the accurate information. We will use reasonable efforts to correct the incorrect information.

9.4. You must notify TeleStar at intcallinfo@gmail.com of any known or suspected breach of security, including theft, loss, or unauthorized disclosure of your password or credit card information, or unauthorized access or use(s) of your account, or any known or suspected.

9.5. You are responsible for any and all use and activity on your TeleStar account. You are responsible for third party users, including employees, authorized or unauthorized by you to use your user ID and password. Any illegal activity, including, but not limited to, fraudulent misrepresentation, may be, at TeleStar's sole discretion, grounds for termination of your account. In certain circumstances, TeleStar may refer you to appropriate law enforcement agencies.

10. LIABILITY

10.1. You agree that TeleStar should not be responsible for any third-party claims against TeleStar that arise from your use of the services. Further, you agree to reimburse TeleStar for all costs and expenses related to the defense of any such claims, including attorneys' fees, unless such claims are based on TeleStar's willful misconduct or gross negligence. This provision will continue to apply after the agreement ends.

10.2. TeleStar will not be liable for any damages if services are interrupted, or there is a problem with the interconnection of TeleStar's services with the services or equipment of some other party. This section continues to apply after the agreement ends.

TeleStar will not be responsible for customers mistakably using direct international calls instead of going through TeleStar services to obtain international or national calls.

10.3. Warranties

Any TeleStar material on this server may include technical inaccuracies or typographical errors. TeleStar has the right to make changes and updates to any information contained within this server without prior notice.

The information provided on this server is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title, no infringement or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by TeleStar internet services inc., its affiliates or their respective employees shall create any warranty. Neither TeleStar nor its affiliates warrants that the information on this server or on the internet generally will be TeleStar or error free or that any information, software or other material accessible from this server is free of viruses or other harmful component

10.4. Legally Required Disclosure

There may be occasions where we are legally required to disclose information about you, such as in response to a subpoena, to prevent fraud, or to comply with a legally permitted inquiry by a governmental agency.

10.5. INDEMNIFICATION

You agree to defend, indemnify and hold TeleStar, its officers, directors, employees, agents, subsidiaries, Customers, Partners, Suppliers, and Affiliates (the "Indemnified Parties"), from and against any and all liability, costs, and settlements, including, without limitation, reasonable attorneys' fees and accounting fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach of this User Agreement by you or any user of any account assigned to you, whether such user is authorized or unauthorized. TeleStar will promptly provide notice to you of any such claim, suit, or proceeding and, at your expense, will reasonably cooperate with you in your handling of such matter.

10.6. SEVERABILITY

If any provision of this User Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the User Agreement, which shall remain in full force and effect.

10.7. WAIVER

No waiver of any of these provisions shall be deemed a further or continuing waiver of such provision or any other provision.

11. FORCE MAJEURE

TeleStar is not liable for failure or delay in performing an obligation under this Agreement that is due to causes beyond its control, such as natural catastrophes, governmental acts or omission, laws or regulations, labor strikes or difficulties, computer viruses, war, transportation stoppages or slowdowns or the inability to procure Content, information, service, carriers, Product, Software, or Demonstrations. If any of these causes continue to prevent or delay performance for more than 180 days, you may terminate this Agreement, effective immediately upon notice to TeleStar.

12. COMPLETE AGREEMENT

These provisions constitute the entire Agreement between you and TeleStar with respect to the use of this Site and any Software, Content, or Product contained therein, unless specified and marked "ADDENDUM" on the site.

14. MISCELLANEOUS PROVISIONS

14.1. Entire Agreement

This Agreement and the terms of any calling plan, promotion, and/or authorized written communications you have received constitute the entire Agreement between you and TeleStar, and supersedes any and all prior agreements, oral or written, concerning the subject matter. If there is any inconsistency or conflict between the terms of any calling plan, promotion, and/or authorized written communications you have received and the provisions of this Agreement, the provisions of this Agreement will control.

14.2. No Obligation to Assist in Switching Carriers

If you voluntarily cancel your TeleStar account or if TeleStar cancels your service for any reason set forth above, TeleStar will have no obligation whatsoever to assist you in any respect in switching from TeleStar to another carrier.

14.3. Assignment

You may not modify or assign this Agreement. In its sole discretion, TeleStar may assign this Agreement.

14.4. No Waiver of Rights

No failure to enforce any right or remedy under this Agreement shall be considered a waiver of any other condition or provision or the same condition or provision at another time.

14.5. Binding Effect

This Agreement is binding upon you and TeleStar, their respective heirs, successors and permitted assigns.

14.6. Severability

If any part or provision of this Agreement is finally determined to be invalid or unenforceable under applicable law, then that part or provision will be ineffective only to the extent of such invalidity or unenforceability, without in any way affecting the remaining parts or provisions of this Agreement.

14.7. Survival

Any liability or obligation of a party to the other party under the Services section and the Payment Provisions section, will, in each case, survive cancellation or termination of this Agreement.

14.8. Headings of No Force or Effect

Headings in this Agreement are for reference only and have no effect on the meaning of any provision.

15. COPYRIGHTS AND TRADEMARKS

15.1 Copyright Notice

Copyright TeleStar LTD. All rights reserved. All material on this site is owned by TeleStar, or its Customers, Partners, Suppliers, or Affiliates, and is protected by national and international copyright law. Unauthorized duplication or distribution is prohibited.

15.2 Trademarks

TeleStar is trademark of TeleStar Limited Company. The names of companies and products mentioned and contained on the Site may be the trademark of their respective owners.

16. IDEA SUBMISSIONS

Our policy is to not accept unsolicited ideas about new marketing, advertising, product, and/or packaging concepts and/or improvements. This policy is to avoid confusion about our ownership of new concepts. If you do send us a message about a proposed new idea, your message will be treated as non-proprietary and non-confidential and becomes our property and may or may not be used by us for any purpose without compensation to you.

17. REPRESENTATIONS AND WARRANTIES

17.1 You represent, warrant and covenant: (a) that you are at least eighteen years old, (b) that all information provided by you is accurate and correct, and (c) that you will not infringe the right of any third party.

17.2 Use of this site is at your sole risk. TeleStar does not represent or warrant: the accuracy or reliability of any content, information, service, product, software, or demonstration contained on the site. Reliance upon such content, information, service, product, software or demonstration shall be at your own risk

17.3 The content, information, services, product, software, and demonstrations, contained herein and provided are done so on an "as is" basis without any warranties of any kind. TeleStar and its respective customers, partners, suppliers, and affiliates, to the fullest extent permitted by law, disclaim all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement of third parties' rights. TeleStar and its respective customers, partners, suppliers, and affiliates make no representations or warranties about the reliability, completeness, accuracy, suitability, current applicability or timeliness of the content, information, services, product, software, and demonstrations on or through the use of the site.

17.4 TeleStar, its officers, directors, employees, agents, licensors, and/or its respective customers, partners, suppliers, and affiliates and suppliers shall in no event be liable for any damages whatsoever, including, without limitation, incidental and consequential damages, damages resulting from lost data or business interruption, or lost profits, resulting from the use or non-use of the site or the content, information, service, product, software, and demonstrations and the related graphics contained therein. such limitations to consequential and incidental damages is in effect and full force whether based on warranty, contract, tort or any other legal theory, and whether or not TeleStar is advised of the possibility of such damages. if you are dissatisfied, your sole and exclusive remedy under this agreement is to discontinue use of this site. since some states/jurisdictions do not allow for the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. remedies under this agreement are exclusive and limited to those expressly provided for in this agreement.
